The FitSmart Membership Agreement is a 12-month term membership, which automatically renews (rolls over)1 into a month to month basis at the end of your term membership unless:
- You cancel your agreement penalty-free within the buyer's remorse period, which is within 3 days2, exclusive of holidays and weekends, of the date you signed and dated the billing agreement and is not from the date you first attended. For example, if you signed the agreement on the third of the month, but did not attend the facility for the first time until the 10th of the month, you would be outside of the buyer's remorse period. This 3-day window exists to allow you time to review the entirety of the contract and the terms therein on your own schedule without the pressure of a sales person, so that you can fully understand the contract that you signed.
- You cancel your term membership with a valid cancellation reason (buy-out, relocation, medical disability)
- You successfully complete your 16 week challenge and cancel within the allowed window (within 5 days after the end of the 16 week program, excluding Sundays and holidays)
- You cancel the roll-over/auto-renew clause of your membership
1 If the facility is in a state (such as Pennsylvania) that prohibits automatic health club membership renewals your membership will end with the successful capture of your final required payment. You will be provided with an opportunity to continue the membership on a month to month basis at your existing rate should you decide to continue the membership after the initial term.
2 Most states allow for a "buyer's remorse" or "right of rescission" period of up to three days to terminate a signed agreement, penalty free. Some states, such as Georgia and Rhode Island extend the "buyer's remorse" period beyond the typical three days. Please review your membership agreement terms and local statutes for specifics. The buyer's remorse period is relative to the date that you signed the agreement, it is not based on when your Challenge begins.
